Welcome to Packagehook! These Terms and Conditions (“Terms”) apply wherever you use our application, online service, and related platforms (called jointly and separately here “the Platform”). Anyone who will visit or use our Platform is subject to the particularities of these extensive Terms. These terms apply to you when you use the Platform, and you confirm and agree to follow the statements made below:

1. Overview of Services

Packagehook is a specific type of transportation company that matches transportation requesters, or ‘Users,’ who may require transportation services with transportation providers, or ‘Drivers.’ Basically, Packagehook only connects buyers with relevant and qualified transportation services provided by independent Drivers. Any transaction conducted through our Platform is governed by these Terms & Conditions.

2. Eligibility

To use our Platform, you must meet the following criteria:

- You must be at least 18 years old or the age of majority as defined by the laws of your jurisdiction.

- You must register for an account and provide accurate, complete, and up-to-date information during the registration process.

- You must comply fully with these Terms as well as all applicable local, state, national, and international laws and regulations.

3. Account Registration

- You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username and password.

- You agree to promptly notify Packagehook of any unauthorized use of your account or any other breach of security.

- Packagehook reserves the right to suspend or terminate accounts that are found to violate these Terms or to engage in fraudulent or harmful activities.

4. Use of the Platform

4.1. User Obligations

- The users of this service are required to provide complete and comprehensive details of the items to be transported and agree to meet all the legal and regulatory requirements as well as safety standards.

- Users are prohibited from requesting or arranging the delivery of an item that is unlawful, dangerous, banned, or restricted under any law or regulation.

4.2. Driver Obligations

– It is required that drivers obtain all the necessary licenses, permits, certifications and insurance to be legally allowed to perform the act of transporting goods as well as ensuring the safety of the transport.

- Drivers alone are fully accountable for safety, compliance with the law, and the provision of the services posted on the Platform.

5. Fees and Payment

- Fees will be assessed to users for services scheduled using the Platform. Before any reservation is confirmed, all relevant fees and charges will be explained in detail.

- Drivers will be paid according to the conditions that were agreed upon and mentioned during the reservation procedure.

- Packagehook has the right to charge drivers and users fair service fees, which will be openly shared prior to any transaction being completed.

- Payments are handled safely by reputable third-party payment processors. By using the Platform, you accept these third-party suppliers' terms and conditions.

6. Cancellations and Refunds

6.1. User Cancellations

- Depending on the cancellation policy offered at the time of booking, users may cancel their reservations. According to the policy, there can be fees for no-shows or late cancellations.

6.2. Driver Cancellations

- In certain situations, such as unexpected events or emergencies, drivers are permitted to cancel reservations. Recurring cancellations, however, could lead to account suspension or termination.

6.3. Refund Policy

- Refunds are subject to the terms outlined in the cancellation policy and are processed in accordance with the policies displayed on the Platform.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities while using the Platform:

- Utilizing the Platform for any unlawful, fraudulent, or malicious purposes.

- Interfering with or disrupting the proper functioning, security, or accessibility of the Platform.

- Posting or transmitting false, misleading, defamatory, or harmful content.

- Violating any applicable local, state, national, or international laws, regulations, or guidelines.

8. Limitation of Liability

- Packagehook is not liable for any loss, damage, injury, or inconvenience arising from the services provided by Drivers or from any interactions facilitated through the Platform.

- Packagehook is not responsible for delays, non-performance, or errors caused by Drivers, Users, or any third-party service providers engaged in the transaction.

9. Indemnification

You also undertake to defend, indemnify and save harmless Packagehook and its partners, directors, officers, employees and agents from any claims, demands, liabilities, costs or expenses arising out of or relating to use of the Platform, non-observance of provisions of these Terms or infringement of any third party’s rights.

10. Intellectual Property

- All the information provided at the Platform, including information realized in text, graphics, logos, images and software belongs to Packagehook or its contractors.

- You are not permitted to copy, adapt, distribute or utilize any part of the content on the Platform without prior permission from Packagehook.

11. Termination

- Packagehook may terminate or suspend your account at any time without giving any reason, including but not limited to, for violation of the provisions of these Terms or for fraudulent purposes.

- And any outstanding obligations will be enforceable upon termination of the Agreement, due to which your access to the Platform will cease.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Lagos State, without regard to conflict of law principles.

13. Dispute Resolution

- Both parties agree to attempt to resolve disputes amicably and informally before pursuing formal legal action or arbitration. Any unresolved disputes will be submitted to binding arbitration.

14. Modifications to Terms

Packagehook reserves the right to modify, update, or revise these Terms at its sole discretion. Any changes will be effective immediately upon posting to the Platform. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

By accessing and using the Packagehook Platform, you explicitly acknowledge that you have read, understood, and agreed to these detailed Terms and Conditions in their entirety.
